Inquiries from International Clients & Foreign Counsel
1. Can a foreign corporation or individual hire a lawyer in Bangladesh without traveling?
Yes. Under Bangladeshi law, foreign corporate entities and individuals can execute a Special Power of Attorney (POA) attested by the Embassy or High Commission of Bangladesh in their country of residence. Once received in Dhaka, our chamber presents the instrument to the Ministry of Foreign Affairs (MOFA) and District Collectorate for stamp authentication, authorizing full legal representation before all courts, arbitration tribunals, and government bodies.
2. How do you recover debts or unpaid invoices from Bangladeshi suppliers or trade partners?
We initiate an urgent documentary audit (contracts, bills of lading, L/C terms, correspondence), serve an authoritative Advocate’s Legal Notice, conduct direct commercial negotiations, and if necessary, institute Money Suits under the Code of Civil Procedure 1908 or criminal proceedings under Section 138 of the Negotiable Instruments Act.
3. Do you act as local co-counsel for foreign law firms and solicitors?
Frequently. We collaborate with overseas solicitors, barristers, and corporate general counsels requiring local execution in Bangladesh. We assist with service of international judicial process, local deposition, evidence preservation, Judge Court trials, and liaising with High Court counsels for writ petitions.
4. Can foreign judgments or arbitral awards be enforced in Bangladesh?
Foreign arbitral awards are enforceable under the Arbitration Act 2001 pursuant to the New York Convention. Foreign court judgments from reciprocating territories (such as the UK) may be executed directly under Section 44A of the Code of Civil Procedure 1908, while decrees from non-reciprocating territories can be sued upon as an independent actionable debt.
5. How is client confidentiality and international communication safeguarded?
All communications are protected under strict Attorney-Client Privilege pursuant to Section 126 of the Evidence Act 1872. Prior to any sensitive document review, we are prepared to execute bilateral Non-Disclosure Agreements (NDAs). Briefings are conducted across time zones via Zoom, Teams, encrypted email, and WhatsApp.
